Personal Injuries

Through the establishment of the Personal Injuries Assessment Board (PIAB) personal injury claims are now made to PIAB firstly for assessment. An application form together with medical reports from your doctors will be submitted to PIAB. The board will then decide on the value of your claim and make an offer to both parties. If either party disagrees with PIABs assessment then a letter of authorisation will be furnished by PIAB and the matter will proceed to Court.

As with all litigation matters there are jurisdiction issues to consider when choosing the appropriate Court to assess your claim:

• District Court – The civil jurisdiction of the District Court in contract and most other matters is where the claim or award does not exceed €6,348.69.
• Circuit Court - The limit of the Circuit Court's jurisdiction relates mainly to actions where the claim does not exceed €38,092.14.
• High Court – there is no limit in respect of the matters before the High Court.
